Those of us in the brownfield world worked diligently with USEPA and other stakeholders to create prosepective purchaser limited liablilty protections under CERCLA. As Robert Blauvelt of GEI Consultants points out, prospective purchasers must, among other things, conduct a Phase 1 Environmental Site Assessment investigation into the previous ownership, uses, and environmental conditions of a property to demonstrate that they have complied with the All Appropriate Inquiry (AAI) provisions of the 2002 Brownfield Amendments to CERCLA and qualify for the protections. USEPA and most lending institutions recognize the use of ASTM International Standards as compliant with the AAI requirements, in particular ASTM E1527-05. (Check out your state requirements, too. They may differ from ASTM's.
