527:Addresses Brownfield and Voluntary Cleanup Tax Credit Issues.
Signed into law by Governor Charlie Crist on June 30, 2008 and is retroactive to
January 1, 2008. Under this new law, Voluntary Cleanup Tax Credits
(VCTC’s) can now be issued for new redevelopment activities that were often the
responsibility of solid waste sites that were redevelopment targets.
Specifically, 1) sorting and screening work that separates solid waste for
reuse, recycling or disposal; 2) transportation of this solid waste to an
off-site solid waste management facility or to a temporary on-site or off-site
staging area; and 3) the ultimate disposal or recycling of solid waste material,
are now eligible for VCTC’s. Applicants for a VCTC are only allowed to file one
solid waste VCTC application after cleanup of solid waste materials has been
completed.

47:6021: Brownfield Investor Credit. Pro-vides a credit of 15
percent towards environmental investigation costs and 50 percent towards
environmental remediation costs incurred as part of a Voluntary Remediation
Investigation (VRI) or a Voluntary Remedial Action (VRA) to individuals to
encourage the cleanup, redevelopment and productive reuse of brownfields sites
in the state. The credit is obtained through the Department of Economic
Development and the Department of Environmental Quality. These credit guidelines
are applicable only to VRI’s or VRA’s approved on or after January 1, 2008.
